In today’s post, we’ll explain what a person’s right of access is and what you can do to make sure you’re properly informing your customers about their rights.
’ In our previous post, we discussed the 2016-2017 HIPAA Audit Industry Report that revealed areas where healthcare practices are falling short in efforts to comply with HIPAA requirements. One of these areas is enforcing a person’s right to access their health care records. Of the audited covered entities, 89 percent failed to show that they were correctly informing patients and customers of their rights. In today’s post, we’ll explain what a person’s right of access is and what you can do to make sure you’re properly informing your customers about their rights. What is a person’s right to use? The Privacy Rule stipulates that individuals have the right to request access to their Protected Health Information (PHI) at any time in the format of their choice or in a hard copy format agreed upon by the individual and the health care practice. It is the responsibility of the practice to implement easy-to-understand policies and procedures that make it easier for an individual to make this request. Practices should also respond in a timely manner and document the request and response to the practice. Common Mistakes The HIPAA Audit Industry Report shows several areas where practices did not comply with privacy rule requirements. The practices did not adequately document the requests, with many reporting that they had not actually received any requests, and there was often a misunderstanding of what constitutes a request. Requests can be of many types, including requests for laboratory results, vaccination records, a copy of the bill, etc. The practices did not have a cost-based fee policy regarding the provision of records. The practices failed to maintain policies requiring timely written refusal. The practices did not include individual rights in the information (NPP) of their privacy practices. The NPP of practices did not properly cover the right of access at the time. There are also inadequate or incorrect policies in practices for individuals to request and receive PHI. For example: mistakenly assuming that a form is sufficient as an access policy to name an authorized representative, requiring a signed authorization form when such forms are not necessary practice incorrectly stating that May deny access to PHI in specific records such as laboratory test results Lack of policies regarding the provision of access to PHI to third parties Fail to allow an individual to request their PHI in a preferred format Having no policy to address isn’t maintained by practice Have a plan for informing your customers. It’s understandable if all of this sounds a little overwhelming, but with a little guidance and planning you can meet your needs. You can be sure to complete it. Fortunately, OCR provides plenty of guidance on how to inform your customers about their rights.
