The Privacy Rule stipulates that individuals have the right to request access to their Protected Health Information (PHI) at any time in the format of their choice or in a hard copy format agreed upon by the individual and the health care practice. It is the responsibility of the practice to implement easy-to-understand policies and procedures that make it easier for an individual to make this request. Practices should also respond in a timely manner and document the request and response to the practice. Common Mistakes The HIPAA Audit Industry Report shows several areas where practices did not comply with privacy rule requirements. The practices did not adequately document the requests, with many reporting that they had not actually received any requests, and there was often a misunderstanding of what constitutes a request. Requests can be of many types, including requests for laboratory results, vaccination records, a copy of the bill, etc. The practices did not have a cost-based fee policy regarding the provision of records.
